SOLUNA STAY – Stay Beyond Ordinary

Last updated: September 2026 · Questions: hello@solunastay.ch

1. Contracting parties and scope

These Terms and Conditions (hereinafter referred to as the “Terms”) govern the legal relationship between the operator of SOLUNA STAY specified in the Legal Notice (hereinafter referred to as the “Host”) and its guests (hereinafter referred to as the “Guest” or “Guests”).

These Terms apply to direct bookings of the furnished accommodation offered at www.solunastay.ch. Separate Terms and Conditions apply to other services such as mentoring or management.

For bookings made through third-party platforms (e.g. Airbnb or Booking.com), the respective platform's terms apply to the formation of the contract, payment and cancellation. The provisions relating to the use of the accommodation, in particular house rules, damages, liability and Wi-Fi, also apply to such bookings.

Individual agreements between the Host and the Guest take precedence over these Terms.

2. Formation of the contract and acceptance of the Terms

The presentation of the accommodation on the website does not constitute a binding contractual offer.

For a direct booking made via www.solunastay.ch, the accommodation contract is concluded upon completion of the booking process and subsequent receipt of the written booking confirmation. The booking confirmation will be sent to the Guest by email without delay.

Before completing the booking, the Guest must expressly accept these Terms and thereby agrees to them in full and without reservation.

The Terms can be viewed at www.solunastay.ch at any time. The booking confirmation also contains a direct link to the current version of the Terms. The version of the Terms accepted by the Guest at the time the contract was concluded shall apply.

Bookings may only be made by persons of legal age.

3. Total prices and payment deadlines

3.1 Prices and services

The total price displayed to the Guest on the website before completion of the booking and confirmed by the Guest shall apply. All prices are final prices in Swiss francs (CHF).

The total price includes:

  • fully furnished accommodation including bed linen, towels and kitchen equipment,
  • free Wi-Fi,
  • all utilities including electricity, heating and hot and cold water,
  • final cleaning including ordinary waste disposal, unless otherwise stated or agreed.

Depending on the accommodation, the following additional costs may apply:

  • visitor's tax or tourism levies,
  • agreed additional services,
  • pet fees, where pets are permitted in the respective accommodation,
  • costs for excessive soiling,
  • costs for damage or missing items,
  • other fees expressly stated before booking.

Further individual services are available on request for an additional charge.

3.2 Payment

For direct bookings, payment can be made by credit card as well as other payment methods offered during the booking process. In exceptional cases, payment by bank transfer is also possible.

Bookings of 1 to 30 nights: The total price is due at the time of booking.

Bookings of 31 nights or more: The cost of the first month is due 7 calendar days after the contract is concluded. For bookings made less than 7 calendar days before check-in, payment is due at the time of booking. However, payment must be received in the Host's account no later than one calendar day before the agreed check-in date.

Subsequent months are due 5 calendar days before the start of each respective month. For this purpose, one month corresponds to 30 calendar days from check-in.

Additional services booked will be invoiced separately according to actual use.

3.3 Late payment

The Guest is required to pay the amounts stated in the booking confirmation or invoices by the applicable due date.

If the Guest fails to pay on time, the Host will grant an additional payment period of 5 calendar days.

If payment remains outstanding, the Host may withdraw from the contract, refuse access to the accommodation and rent the accommodation to another party. In this case, the cancellation consequences set out in Section 6 apply; payments already made will be credited.

Failure to make payment does not automatically constitute a free cancellation by the Guest.

4. Arrival and departure

Check-in on the day of arrival is generally possible from 16:00.

Check-out on the day of departure must take place no later than 11:00, unless a different time has been agreed for the booked accommodation.

Different arrival or departure times are only possible by prior arrangement.

Before arrival, the Guest must provide via the online check-in form the details of all overnight guests required for the statutory guest registration and, where applicable, the visitor's tax.

The access code for the key box containing the property key will be sent to the Guest by email before arrival once payment has been received and the guest registration has been fully completed. If the guest registration is not completed in time, check-in may be delayed.

The accommodation will only be made available to the Guest after it has been cleaned and prepared by the Host. Occupying the accommodation before the agreed check-in time or before it has been released by the Host is not permitted.

In the event of an unagreed late departure, the Guest may be charged for any demonstrable costs and losses arising as a result.

These include in particular:

  • additional cleaning or staffing costs,
  • waiting times,
  • costs of necessary alternative accommodation for a subsequent guest,
  • loss of revenue,
  • other demonstrable losses.

The Host will keep any resulting loss to a reasonable minimum.

The Guest must leave the accommodation in a tidy condition upon departure. If the condition of the accommodation requires an above-average amount of cleaning, the additional time required will be charged at CHF 50 per commenced hour.

Personal belongings left behind by the Guest after departure will, where possible, be kept for 14 days. Shipping can be arranged at the Guest's request. The Guest is responsible for postage and packaging costs. Items that are not collected or claimed within this period may subsequently be disposed of or otherwise utilised.

5. Changes to bookings

Any change to a booking, in particular relating to the arrival or departure date, duration of stay or type of accommodation, is only valid with the Host's consent and once a new booking confirmation has been issued.

There is no entitlement to rebooking. If the Host agrees to a rebooking, the total price may change according to the prices applicable at the new time.

Amounts already paid are generally non-refundable.

6. Cancellation by the Guest

6.1 Form and timing

The Guest may cancel the booking before the agreed check-in in writing by email to hello@solunastay.ch.

The relevant time is the time in Switzerland at which the cancellation is received by the Host. The Host will confirm receipt.

6.2 Free cancellation

Cancellation is free of charge if there are at least

  • 14 full calendar days between the date of cancellation and the arrival date for bookings of 1 to 30 nights, or
  • 30 full calendar days between the date of cancellation and the arrival date for bookings of 31 nights or more

respectively.

Example for 1 to 30 nights: For an agreed check-in on 20 August, a free cancellation must be received by the Host no later than 5 August at 23:59.

Example for 31 nights or more: For an agreed check-in on 20 August, a free cancellation must be received by the Host no later than 20 July at 23:59.

6.3 Later cancellation

If the cancellation is received later, the following amounts are due:

  • for bookings of 1 to 30 nights: 100% of the total price,
  • for bookings of 31 nights or more: the cost of the first month.

If the Host is able to re-rent the accommodation for the booked period, the proceeds will be credited.

6.4 No-show, non-use, early departure

The respective amount under Section 6.3 is also due in the event of:

  • failure to arrive without notification by 10:00 on the calendar day following the agreed arrival date,
  • early departure at the Guest's request,
  • non-use of the accommodation for reasons within the Guest's responsibility.

In the event of early departure for stays of 31 nights or more, the accommodation must be paid for until the end of the current month.

6.5 Refunds and right of withdrawal

In the event of a free cancellation, the Host will refund amounts paid to the original payment method within 14 calendar days.

There is no statutory right of withdrawal.

7. Cancellation or termination of the contract by the Host

If the accommodation cannot be made available due to force majeure, official orders, significant technical damage or other circumstances beyond the Host's control, the Host will, where possible, offer equivalent alternative accommodation.

If the Guest declines this or no alternative accommodation is available, the Host may cancel the contract and refund the amounts paid for the affected period. Further claims exist only to the extent required by mandatory statutory provisions.

In the event of serious or, following an unsuccessful warning, repeated breaches of the contract or house rules, the Host may terminate the contract with immediate effect for good cause and require the Guest to leave the accommodation. If the Guest refuses, the police may be called.

Serious breaches include in particular:

  • violence or threats of violence,
  • serious insults or intimidation,
  • significant or repeated disturbance of the peace,
  • parties or events without permission,
  • commercial or illegal use under Section 11.7,
  • intentional damage to property,
  • unauthorised over-occupancy,
  • passing access codes or keys to unauthorised persons,
  • tampering with smoke detectors, safety systems or technical equipment,
  • refusal of access in the event of an emergency or urgent damage.

Amounts already paid may be retained in the event of serious breaches to the extent permitted by law. Mandatory statutory claims and further claims for damages remain unaffected.

8. Number of guests and use of the accommodation

No more persons may stay overnight than are stated in the booking confirmation.

Additional overnight guests are only permitted with the Host's prior written consent and will be charged at the applicable rates. Without such consent, the Host may require their immediate removal.

Children are welcome in the accommodation provided that the maximum occupancy stated in the booking confirmation is observed. The accommodation is not fully childproof throughout. The supervision and safety of accompanying children is the responsibility of their legal guardians.

Visitors are permitted to a reasonable extent but must not result in over-occupancy, disturbance of the peace or use that is inconsistent with the contract. Further costs and damages remain reserved.

The Guest agrees to treat the accommodation, communal areas and all inventory, furnishings and appliances with the utmost care.

The accommodation may be used for residential and accommodation purposes, including by business travellers. Working from home without receiving clients is permitted.

Without the Host's prior written consent, any further commercial use is prohibited, in particular receiving clients or business partners, use as a photo studio, storage facility or production site, as well as providing services to third parties on the premises.

The Guest may neither sublet the accommodation nor make it available to third parties for payment or free of charge.

No structural alterations may be made to the accommodation or communal areas.

9. Guest obligations and damage

The Guest is liable for damage caused by the Guest, accompanying travellers, visitors or animals brought onto the property, as well as for the loss of keys or access devices. Normal wear and tear is excluded.

Theft, intentional damage to property and other criminal offences may be reported to the authorities. In such cases, the Host may terminate the contract immediately in accordance with Section 7.

Damage and malfunctions must be reported to the Host immediately. Contact details are provided in Section 16.

Without the Host's consent, no repairs, alterations or interventions may be carried out on:

  • water pipes or drains,
  • electrical installations,
  • appliances,
  • furniture,
  • locks,
  • other facilities.

Necessary immediate measures to prevent more extensive damage remain permitted. The Host must be informed immediately.

The Guest is also liable for items from the inventory, e.g. keys, remote controls, dishes, bed linen or other furnishings, which go missing during the stay or are no longer fully present upon departure.

The corresponding replacement costs may be charged to the Guest.

10. Defects and remedies

Defects identified upon arrival or occurring during the stay must be reported to the Host immediately.

The Guest must describe the defect in a comprehensible manner and, where possible, document it with photos or other suitable evidence.

The Host must be given a reasonable opportunity to inspect and remedy the defect.

The Guest must contribute to limiting any damage to a reasonable extent.

If a defect significantly impairs the use of the accommodation and cannot be remedied within a reasonable period, the Host will, where possible, offer alternative accommodation or grant an appropriate price reduction.

If the Guest culpably fails to report the defect in good time and this prevents or significantly complicates a remedy, possible claims may be reduced or excluded to the extent permitted by law.

Reporting a defect only after departure does not automatically exclude claims. However, the Guest must be able to prove that the alleged defect existed during the stay and that an earlier report was not possible or reasonable.

11. House rules

11.1 Smoking

Smoking and vaping are completely prohibited inside the accommodation and inside the building.

This applies in particular to:

  • cigarettes,
  • cigars,
  • cannabis,
  • e-cigarettes,
  • vapes,
  • comparable products.

Open flames and candles are also prohibited. Smoking is only permitted outdoors.

Breaches of the smoking ban will result in a flat fee of CHF 250.–. Additional actual costs for specialist cleaning, odour removal, repairs, replacement of textiles or loss of rental income may also be claimed.

In the event of a repeated or serious breach, the contract may be terminated in accordance with Section 7.

11.2 Parties, noise and quiet hours

Parties, unagreed events and excessive noise are not permitted. This also applies on balconies, terraces and in communal areas of the building.

Quiet hours from 22:00 to 07:00 and the house rules for the respective accommodation or building contained in the digital guest guide must be observed.

11.3 Communal areas

When using communal areas, stairwells and all corridors, the Guest must show consideration for other residents and keep these areas clean.

Personal belongings may not be stored in these areas, as they could obstruct escape routes in an emergency.

11.4 Parking spaces

A parking space is only included in the booking if this is expressly stated on the accommodation page, during the booking process or in the booking details.

The Guest may only use the parking space assigned to them. The Guest is liable for towing costs and fines resulting from unauthorised parking, as well as for any damage caused by the Guest.

Charging electric vehicles is only permitted if an appropriate and approved charging facility has expressly been made available for this purpose.

11.5 Waste disposal

General waste must be disposed of in the waste bag (official fee bag) provided by the Host. Recyclable materials, e.g. PET, glass, cardboard and aluminium, must be collected separately in the containers provided.

At check-out, waste bags may be left in the accommodation. The cleaning team will take care of proper disposal.

11.6 Pets

Pets are only permitted in accordance with the conditions specified for the respective accommodation or with the Host's prior consent.

Individual accommodation may be subject to restrictions regarding the type, size or weight of animals. The conditions stated at the time of booking shall apply.

Guide and assistance dogs are exempt from the pet restrictions and should be notified in advance.

If pets are brought without permission, demonstrable additional cleaning, repair or loss-of-use costs may be charged.

11.7 Commercial and illegal use

Without express written consent, the following are prohibited in particular:

  • offering or receiving erotic or sexual services of any kind, in particular prostitution and escort services,
  • commercial photo or video shoots,
  • pornographic recordings,
  • selling or trading goods or services,
  • events or meetings of a commercial nature.

Illegal activities are prohibited at all times.

11.8 Safety equipment

Smoke detectors, fire alarms, fuses, locks and other safety or building equipment must not be removed, covered, disabled or tampered with.

Vandalism or misuse of facilities will not be tolerated and may have legal and financial consequences. Any unusual incidents must be reported to the Host immediately.

11.9 Emergencies

In an emergency, contact the police (117), fire brigade (118), ambulance service (144) or the European emergency number (112).

12. Host's right of access

The Host respects the Guest's privacy.

Access to the accommodation during the stay will only take place after prior notice and by appointment, specifically:

  • to carry out agreed repairs or maintenance work,
  • to inspect a reported defect,
  • where there are reasonable grounds to suspect a serious breach of contract.

In emergencies, in particular in the event of fire, water leakage, smell of gas, significant risk to property or danger to persons, the Host or a person authorised by the Host may enter the accommodation without the Guest's prior consent.

Access must be limited to what is necessary.

13. Liability and insurance

The Host is liable in accordance with statutory provisions.

Liability for damage caused by improper use, use for an unintended purpose or use contrary to operating instructions of appliances, facilities or inventory by the Guest is excluded to the extent permitted by law.

The Host is not liable for disruptions outside the Host's sphere of influence. These include in particular:

  • temporary power, water, internet or heating outages,
  • official measures,
  • construction work or traffic noise outside the property; the Host will inform Guests in advance of known construction work,
  • weather or natural events,
  • disruptions caused by third parties.

The Host will assist the Guest to a reasonable extent in remedying or limiting such disruptions. Any entitlement to a price reduction under Section 10 remains unaffected.

The Host is only liable for the loss, theft or damage of personal belongings or vehicles to the extent required by mandatory statutory provisions.

The Guest and the Guest's personal belongings are not insured by the Host.

Personal liability insurance and cancellation insurance are the responsibility of the Guest and are recommended.

14. Use of Wi-Fi

The Wi-Fi provided may only be used during the booked stay.

Login details may only be shared with authorised Guests.

The Host may block access in the event of misuse, security issues or breaches of contract.

The Guest is required to comply with applicable law when using the Wi-Fi.

The following are prohibited in particular:

  • unauthorised distribution or reproduction of copyright-protected content,
  • illegal downloads or uploads,
  • sending insulting, threatening or defamatory content,
  • sending spam,
  • hacking, malware or attacks on IT systems,
  • other unlawful acts.

Legal transactions and paid services used or concluded by the Guest via the Wi-Fi are undertaken at the Guest's own responsibility and expense.

Within the scope of statutory provisions, the Guest is liable for unlawful use of the Wi-Fi attributable to the Guest or to persons to whom the Guest has provided access.

No specific transmission speed or uninterrupted availability is guaranteed.

15. Data protection

The Host processes the Guest's personal data to the extent required for bookings and the operation of the accommodation or where required by law, in particular for:

  • processing enquiries,
  • concluding and fulfilling bookings,
  • communication with Guests,
  • payment processing,
  • fulfilment of legal obligations,
  • asserting or defending legal claims,
  • the security of the accommodation,
  • preventing misuse.

Further information can be found in the SOLUNA STAY Privacy Policy. The Guest acknowledges the Privacy Policy.

16. Communication

For the purposes of these Terms, communication by email is sufficient to satisfy the requirement of written form.

For evidentiary purposes, communications from the Host, including booking confirmations, invoices, cancellation confirmations and contractual amendments, will generally be sent by email.

Enquiries and complaints should be sent by the Guest to hello@solunastay.ch. Section 6 applies to cancellations.

The Guest must provide a current and accessible email address and telephone number.

Communication must remain factual and appropriate. Insults, threats, harassment or inappropriate contact directed at the Host, employees, contractors or other persons involved may result in termination of the business relationship, a ban from the premises and, where applicable, legal action.

17. Ban from the premises

In the event of serious misconduct, the Host may impose a ban covering individual or all accommodation operated or managed by the Host, as well as the associated communal and outdoor areas.

A ban may be imposed in particular in the event of serious breaches under Section 7, serious or repeated insults, harassment, unauthorised entry into accommodation or attempts to circumvent a ban through other persons or booking accounts.

A ban will generally be communicated in writing.

18. Images and amenities

Photos, floor plans and descriptions are intended to provide as realistic a representation of the accommodation as possible.

Minor deviations do not give rise to any claim provided that the usability and essential character of the accommodation are not affected.

The Host may replace furniture, appliances or amenities with items of equivalent or higher quality.

19. Applicable law and jurisdiction

The contractual relationship is governed by Swiss law.

The place of jurisdiction for all disputes is Schwyz (Canton of Schwyz, Switzerland). Mandatory statutory provisions and jurisdictions, in particular those protecting consumers, remain unaffected.

20. Final provisions

Amendments or additions to the contract must at least be made in writing in accordance with Section 16, unless another form is required by law.

Should any provision of these Terms be wholly or partially invalid or unenforceable, the remaining provisions shall remain unaffected.

The parties will then endeavour to agree on a permissible provision that comes as close as possible to the intended arrangement. If no agreement is reached, the statutory provisions shall apply.

The Host may amend or supplement these Terms at any time without prior notice. The current version is available at www.solunastay.ch and applies to all bookings made from the date of the amendment.

For bookings already concluded, the version accepted at the time the contract was concluded shall apply.
